Ex-Post Verification of Compliance with CO2 Limits for Capacity Year 2024/2025

Dear Capacity Market Participants,

 

In accordance with paragraph I.1.2A.1, Participants shall, in respect to each of its Capacity Market Units that either:

(a)   burns mixed fuel as defined in Article 3(34) of Regulation (EU) 2018/2066;

(b)   burns waste as defined in point (1) of Article 3 of Directive 2008/98/EC, excluding substances that have been intentionally modified or contaminated in order to meet this definition; or

(c)   is a unit where CO2 is captured and transferred as described in points (a) and (b) of the first subparagraph of Article 49 of Regulation (EU) 2018/2066

... provide, to the System Operators, evidence of its compliance with the CO2 Limits in each Capacity Year by the end of March following the end of such Capacity Year.

 

Evidence is required in respect of Capacity Market Units with Awarded Capacity in 2024/2025 for Generation Units (including Demand Side Units and Aggregated Generator Units and any components thereof) that meet one of the above criteria set out in paragraph I.1.2A.1.

 

For Generation Units (including Demand Side Units and Aggregated Generator Units and any components thereof) that burn fuels with a biomass fraction of 100%, the above evidence should be submitted under mixed fuels to confirm that the fuel is not of fossil fuel origin and also to confirm that the fuel meets the criteria set out in Article 29 of Directive 2018/2001/EU to be eligible for financial support (i.e. Proof of Sustainability). 

 

For the avoidance of doubt, submissions are not required in respect of Capacity Market Units where the above criteria do not apply. 

 

Please submit evidence of compliance with CO2 Limits for Capacity Year 2024/2025 to CapacityMarket@sem-o.com using the ​Ex-Post Verification of Compliance with CO2 Limits form​ by 10th April 2026

 

Following receipt of the above evidence, the System Operators will seek any further information or clarification (including where required, a report certified by a third-part verifier) by the 24th April 2026.  The participant will have until 8th May 2026 to submit any further information and may request a further two weeks up to the 22nd May 2026 (where additional time is reasonably required to provide the further information).
